FMLA Recordkeeping Folders

Alert: On February 5th, 2013, the anniversary of the Family & Medical Leave Act, the U.S. Department of Labor issued a final rule expanding the benefits available to both airline flight crew and military families. These FMLA changes create additional compliance requirements for businesses. In order to stay in compliance, businesses will need to display the new mandatory FMLA poster and utilize updated FMLA forms, workplace policies and training tools effective March 8th, 2013.

Any forms for FMLA leave cannot be stored in general personnel files but require confidential medical records folders for recordkeeping. Additional employee information needs to be documented for any employee using FMLA, including payroll, weekly hours worked and total compensation paid. Ensure you store documents in the right recordkeeping folders in the chance government officials request all recorded documentation for compliance.
